In a move that has left Jewish leaders deeply frustrated, calls for a compromise on hate speech laws have intensified after Labor backtracked on a critical bill. But here's where it gets controversial: while the government pushes forward with gun control and immigration measures, the most contentious aspects of the legislation—those addressing vilification and intimidation—have been put on hold due to fierce opposition from both sides of the political spectrum. And this is the part most people miss: Jewish leaders warn that without these protections, their community remains vulnerable to the growing threat of antisemitic hatred.
Following the Bondi Beach terror attack, Prime Minister Anthony Albanese agreed to split the draft laws, paving the way for new gun control measures, immigration powers, and a scheme to designate extremist organizations. These changes, supported by the Greens, are set to pass. However, the delay in addressing hate speech has sparked outrage. Peter Wertheim, co-chief executive of the Executive Council of Australian Jewry, urged Albanese and Opposition Leader Sussan Ley to immediately negotiate stronger protections.
“We are deeply disappointed that a serious vilification offense won’t be included,” Wertheim said on Sunday. “This sends a dangerous message: that the deliberate promotion of racial hatred isn’t serious enough to criminalize. How much worse does it need to get before we, as a nation, confront the root of the problem—the unchecked spread of antisemitic hatred?”
The political blame game continues, with both major parties accusing each other of rushing the process. Ley, after meeting with the Coalition leadership, prepared to chair a shadow cabinet meeting, while Shadow Home Affairs Minister Jonathon Duniam criticized the government’s handling of the issue. “They’ve completely botched this,” Duniam said. “This should have been a collaborative effort weeks ago, involving all parties and communities—Jewish, Muslim, firearms representatives—to get it right. Their failure is why we’re scrambling at the 11th hour.”
The proposed gun laws are significant, including the largest buyback since the Port Arthur massacre, stricter rules on gun imports, and new criminal offenses for online material related to firearm and explosive manufacturing. Intelligence agencies like ASIO would also conduct criminal background checks for firearms license applicants. Additionally, the government would gain powers to ban extremist groups, such as neo-Nazi and Islamist organizations, and to revoke or refuse visas for individuals with extremist views.
Labor’s Senate manager, Finance Minister Katy Gallagher, challenged Ley to honor her earlier commitment to support the measures, made after 15 people were killed at a Jewish Hanukkah event on December 14. “Today is about unity and putting Australians first,” Gallagher said. “Australians want to see their parliament working together, and that’s our approach.”
However, the Australian Federation of Islamic Councils (AFIC) defended the pause on hate speech provisions, criticizing the rushed process. AFIC President Rateb Jneid warned that the proposed rules for designating hate organizations were dangerous and called for a redraft. “When the power to outlaw groups relies on secret evidence and political discretion, it stops being about justice and becomes about ideology and politics backed by state force,” Jneid said. “This isn’t how a democracy should address hate.”
